I've gotten this warning many times in extremely fast time controls (mostly 3 0) as a result of overstepping the limit whilst searching (often for as little as a few dozen seconds or so) for a desperate way out in a complicated position. The computer has zero conception of what's trivial for a human to calculate and using its evaluations to flag these games merely adds insult to injury to a lost (but in no way unsporting) game.

I'd also like to add that "the warning doesn't mean much" isn't a particularly convincing rationale for the message - first off, most people receiving it don't know and/or could be reasonably expected to know what it means. For all we know, it's a serious offense. Secondly, it isn't so much the threat of some sort of timeout or ban that is offensive as much as the implication that one's behavior was in some way improper when it very much was not.
There is not much to comment on if we don’t have examples. But from what i have seen as a mod, it works very well. In most of the cases that people argue against it i am very comfortable with warning them. And the alternative of giving the playbans with no heads up seems worse to me

FWIW I suspect that the instances a moderator would be examining would be far more likely to be blatant than “one-off”s that don’t amount to anything actionable, and in any event would argue that only the most brazen instances of “stalling” in a 3 0 game would really warrant a playban. Having to wait a minute to win a chess game seems a petty enough concern, but if it must be programmatically addressed then I would suggest flagging the game for human moderation before counting it as an “offense” and perhaps leaving it at the discretion of one’s opponent to report.

And I'm not entirely fine with you being in a position to judge it? 🤷 In all seriousness, in what way (other than simply by appointment) are you qualified to state how long I should be thinking in a complex position in which there were tons of interesting options to consider which I'm happy to explain (but really shouldn't have to), including 26... Rh1!?, 26...Qg4!? and so forth?
