Legendary Creature — Human Rogue
When The Magic Bandit deals combat damage to an opponent, exile the top card of that player's library. You may cast that card for as long as it remains exiled, and mana of any type can be spent to cast that spell.
Whenever you cast a spell or play a land you don't own, copy it.

If you cast this spell for its mutate cost, put it over or under target non-Human creature you own. They mutate into the creature on top plus all abilities from under it.
I think it is correct. You do not own the spell so it can only target the opponent's (owner) creatures.
When you cast the spell, the owner check should be changed

702.140a Mutate appears on some creature cards. It represents a static ability that functions while the spell with mutate is on the stack. “Mutate [cost]” means “You may pay [cost] rather than pay this spell’s mana cost. If you do, it becomes a mutating creature spell and targets a non-Human creature with the same owner as this spell.” Casting a spell using its mutate ability follows the rules for paying alternative costs (see 601.2b and 601.2f–h).
