I understood it as just avoiding the subjunctive by turning the subordinate clause to an infinitive

J’empeche qu’il fasse qqch = Je l’empeche de faire qqch

« n’empeche » is actually an adverb meaning ‘nonetheless/nevertheless’ though I do agree the meaning is different
