in that instance I'd say subjunctive vs indicative would be the way to tell

I think I'm a little confused about what you mean. I don't think subjunctive vs indicative of the verb here would indicate anything about whether its negative or positive. The use of subjunctive depends on the que clause before the pouvoir and has nothing(?) to do with whther pouvoir is negative or positive.

Is there something about negatives and subjunctive im missing?

Ne explétif is used with subjunctive

Basically if it can be ne explétif I would assume it's that over anything else
