(1) Only claimed land is generally considered to be property of an entity. Unclaimed land is public and can be claimed and / or used by everyone with no regards to something already existing on that land, except for

  1. publicly accessible infrastructure like roads, such is always owned by the competent authority, even when it is claimed by a non-governmental entity.
  2. unclaimed property that must reasonably be assumed to be part of a nearby claimed property and is unclaimed by accident.
  3. legally reserved property.
