3ds was reading that my battery was at 1%, even tho it wasn't. In reality it was charging above 1% but wasn't showing it.
I let it discharge and then I charged it again and it worked.

So if it gets stuck on 1% just let it die and recharge, I made the mistake of (unknowingly) charging it to 100% so it took ages to discharge
