i've been wanting to buy another 3ds xl since mine is currently deteriorating so the question is can i still open eshop to download the games that i have bought from eshop

yes you can download past purchases as well as updates

if you are buying a new console remember you have to do a system transfer, you're not able to just log into the NNID on a new console
