It's fake. The Nintendo logo never appears on legitimate (North American) sealed games.
There is a Nintendo strip on the wrapping
It's only present on European games. If you have a North American copy (by having an ESRB logo) and it has that strip, it's 99% fake

I am reading on Google, and apparently there are some re releases with red cases that were released at the end of the ds lifecycle
so there could be a chance that it's real

Mainly because the 3DS carts are more secure and flashcarts where more popular back then

I though you can buy fake eu nintendo foils somewhere in asia for resealing. For me are sealed games therefore completly uninteresting: you dont know really if the right game is in there...
It depends how much they cost for me, if they cost like 5 bucks more than a unsealed copy then I rather just get the new one that's in better condition.
