If you settle the dispute between Captain Aelfyr and the Militia BEFORE you do Escape Plan, then she no longer exists. You cannot turn in the refugees because of this.

Also if you turn them in, the smuggler conversation doesn't reflect that at all and still plays as if you're helping them.
