Uniform Code of Military Justice

These are sets of laws and rules used by GOVFOR/OPFOR and all relevant military factions.

Basic Principles

  • All personnel are required to both enforce the law and abide by it.

  • MP/Law Enforcement and Command may, at their discretion, ignore Minor Crimes unless they are ordered to enforce one by a higher position.

  • MP/Law Enforcement breaking the law in any capacity cannot be ignored.

  • Charges are not to be applied to those who use force on others when defending themselves from illegal harm, so long as they defend themselves with proportional force. This also extends to the defense of others if they believe the others are in lethal danger.

  • No person may serve more than thirty minutes in the brig for the total accumulation of their crimes at time of sentencing, unless on permanent confinement.

  • At no point is an execution ever to be sanctioned nor is it legal.

Law Rank Structure

Bear in mind that this is not the standard rank structure and should only be used for matters pertaining to UCMJ. The standard rank structure can be found in the SOP.

Should there be a disagreement on a legal case regarding UCMJ, GOVFOR/OPFOR Law rank structure must be followed in order of top to bottom:

  • High Command
  • MP/Law Enforcement
  • Faction Command
  • Deputized MP/Law Enforcement

If two members of the same position are present (for example if you have only Faction Command present), the person of the highest rank shall have the highest authority.

Right to Appeal

Anyone under the jurisdiction of the UCMJ has the right to appeal their punishment to their choice of either the Acting Commander or High Command via fax, who may also choose to designate someone else to handle the appeal in their place. If either person picked is involved in the crimes, they should designate an uninvolved MP/Law Enforcement Officer or warrant/commissioned officer. Whomever is handling the appeal has the final say in the outcome of the appeal.

Appeal Outcomes & Handling

A charge cannot be removed by appeal if the prisoner is found guilty, however, the person who handles the appeal can process the appeal as:

  • A valid charge, no modification.
  • Modify the charge to a lower charge.
  • Reduce the punishment of a charge up to the minimum punishment.
  • Remove a charge the prisoner is found innocent for.

Appeals must be handled before demotions and NJPs. Appealing prisoners should have their brig timers set and running while the appeal is being processed. Personnel may be placed in holding awaiting their appeal if it had no brig sentence.

Appeal Delays

Appeals may only be postponed if:

  • There are threats onboard the ship or installation requiring immediate attention.

  • Riots or jailbreaks onboard the faction ship or installation requiring immediate attention.

  • The prisoner requiring medical treatment.

  • There being an already processing appeal.

  • The prisoner having escaped or is unreachable in person.

Non-Judicial Punishments

Non-Judicial Punishments (NJPs) are disciplinary measures used to resolve minor offenses without arresting personnel.

Any Non-Commissioned Officer (Corporal+) or higher may issue an NJP.

An NJP may not be used in the place of an arrest for anything but minor or optional offenses.

General Usage

  • NJPs should not risk the person's health.

  • NJPs cannot take longer than the original sentence, or a 10 minute brig timer if none exists.

  • If the NJP offer is refused, they are to serve the original sentence, or a 10 minute brig timer if none exists.

  • Accepting an NJP waives the right to appeal.

Arresting Procedures

Should an Officer order an arrest for a crime, MPs/Law Enforcement MUST arrest that person.

Arresting a Suspect

  • Take down the Suspect if they resist and securely restrain them.
  • Non-lethal force must be used unless the suspect is armed with a lethal weapon and has shown intent to use it.
  • Move the Suspect to a holding cell.

Field Arrests

These refer to arrests performed in the area of operations.

  • Anyone may detain personnel of their faction that commit a major or capital crime, but must detain personnel of their faction by orders of the MP/Law Enforcement, commander, or any officer.

  • Anyone may detain personnel deploying unauthorized, even without orders to do so.

  • Personnel detained should be passed onto the MP/Law Enforcement or an Officer in a secure area when possible.

  • MPs/Law Enforcement MAY leave the FOB to detain or arrest members of their faction who have committed any offense that is not minor or optional, but must disengage and return to the FOB if attacked by anyone other than the suspect they are pursuing.

Minor Crimes

These crimes are low severity and can be alternatively punished with an NJP.

Failure to Follow Procedure

Failing to follow the regulations found in the Standard Operating Procedure.

  • 10 minutes, equipment confiscation where relevant.

Smoking in Medical Areas

Smoking in areas designated for use by medical personnel, such as the entire medbay and surgical rooms.

  • NJP

Hooliganism

Behavior that is generally disruptive to the ship or installation and its personnel that classifies as low-level shenanigans not deserving of more severe punishment. Things such as excessive window knocking, force-feeding or failing to conduct oneself properly during the briefing, such as climbing the briefing overview.

  • 6 minutes.

Trespassing

Unauthorized access of an area which a person does not normally have access to or without command/superior approval.

  • 9 minutes.

Intoxication

To consume alcohol, marijuana or other substances such as drugs resulting in being mentally or physically impaired.

  • 10 minutes, extended until the person is no longer impaired.

Theft

To take items (or property) from another person or entity without their express permission, or to retain possession of items that have been taken without permission. This includes the removal of vendors from department areas without permission.

  • 10 minutes, and the item(s) returned to the owner.

Disrespecting a Superior Officer

Using offensive names, failing to salute an officer or being directly disrespectful to an officer of higher rank or position.

  • NJP

Insubordination

To ignore or not execute the lawful orders of higher ranking personnel.

  • 12 minutes.

False Testimony

To intentionally and willingly lie to an MP/Law Enforcement Officer, or deputized officer, during a criminal investigation with the intent to disrupt said investigation.

  • 5 minutes, in relation to a minor crime.

  • 15 minutes, in relation to a major crime.

  • 20 minutes, in relation to a capital crime.

Major Crimes

These crimes are high severity.

Disorderly Conduct

Directly and intentionally disrupting primary operations of the group. Fighting in the requisitions line, extensively or repeatedly disrupting the briefing.

  • 10 minutes.

Neglect of Duty

Failure to perform one's role to an acceptable standard. For example, a Commander failing to properly organize and ensure their personnel are given orders, failing to follow proper procedure in detriment of one's duties, or ship crew leaving the ship/installation or their post without authorization from Command.

  • 15 minutes.

Assault

To threaten or use physical force against someone with ill intent.

  • 10 minutes, without a deadly weapon.
  • 15 minutes, with a deadly weapon.

Prevarication

To intentionally order the arrest of a person on false charges who is then found to be innocent, or to apply an improper or abusive NJP. This includes intentionally arresting a person on false charges on one's own initiative without orders.

  • 10 minutes.

Manslaughter

Killing someone without malicious intent. Manslaughter may be applied if someone dies as a result of a fight where the intent was not to kill.

  • 15 minutes.

Illegal Confinement

Unlawfully detaining a person against their will. Includes kidnapping, hostage-taking, and confining people in cells without charging them for a crime. It does not apply to Prisoners of War.

  • 20 minutes.

Unauthorized Deployment

To deploy into the area of operations without permission of the relevant command.

  • 20 minutes.

Optional Crimes

These crimes can be added on to existing charges where relevant.

Resisting Arrest

To resist a lawful arrest or search by an officer.

  • 5 minutes, refusing to comply with a lawful search or arrest.
  • 10 minutes, resisting a legal arrest by fleeing or using force.

Aiding and Abetting

Assisting others in committing a crime, directly or indirectly, or encouraging them to commit one. Any person Aiding and Abetting is required to be told the crimes of the person they aided.

  • Same punishment as crime committed.

Disorderly Conduct in Confinement

To cause disruption in a significant manner while in brig and under arrest. This can be added on to any charge.

  • 7 minutes.

Capital Crimes

These crimes are extreme severity. All of these crimes are punished by permanent confinement and demotion.

Jailbreak/Escape

To escape, assist in an escape, attempt escape, or be willfully and knowingly broken out from a cell.

Attempted Murder

Attempting to murder a person but failing to do so. If the evidence shows that the arrested person was clearly trying to kill someone with ill intent but failed in the action itself.

Murder

Killing someone with malicious intent. This includes Synthetic units. The charge applies even if the victim is later revived.

Sedition

To engage in actions or refuse to follow orders so as to overthrow or usurp the legitimate command structure. Creating a massive threat to the ship without the knowledge and approval of command falls under sedition.

Desertion

Refusing to carry out the duties essential to one's post or abandoning post unauthorized, without intent to return. (Retreating from the planet when the FOB is breached is not desertion, refusing to return when ordered is.)

Crimes Against Humanity

To engage in actions that violate human rights or otherwise are heinous acts against human life. Examples are torture, cannibalism, and forced infection of any kind.

Precautionary Charges

These are used to confine people indefinitely.

Insanity

Acting in such a manner which makes the offender not sound of mind and a danger to themselves and others, for example, attempting suicide.

  • Confinement until they are no longer a threat to themselves and others.

Prisoner of War

Any detained combatant as defined in the [Definitions and Glossary](#1470096627070013460 message).

  • Discretionary confinement, usually permanent.
