So without leaking any email addresses here (Seriously, don't share email address here), it sounds like the email address on your account is actually your mom's email?

ye so i don’t want to change the email on her account to mine cuz she still using her microsoft account for other stuff so was wondering if i could change it to my email on a new microsoft account
There is not a way to migrate over to a new Microsoft account. You can only change the email of an existing account.
Would you say the situation you are in is your Xbox account and your mom's Microsoft account are the same thing? There is only one account right now?
so my main account is with my mums email and the stuff on there i’ve had for years now and would probably want to keep but i do have another xbox account with my microsoft account and email i made recently but obviously i don’t have all my stuff from my main so i was wondering if i could just use my microsoft account with my email and switch it to my main xbox account but it looks like i can’t do that
I feel like it'd be best for you to contact official support for this and see what they say. They might have steps to get you in a less messy state.
