Do you mean its still installed in your Xbox library? If so then that's because when your Game Pass ends games you have installed from GP stay installed but you cant play them. And if you mean its just in your owned games then it might be a glitch try restarting your console.

He doesnt have it downloaded, its only in his owned games I guess and it doesnt let him uninstall it.

This has happened to me before, years before Game Pass existed. Got home and CoD: Advanced Warfare was downloading onto my XB1... but I was actually able to play it for a while, lol. (The licence was removed from my console some time later). Never figured out what caused that anomaly.

That is pretty much a telltale sign of someone else having set your console as Home Xbox. Buying something used to (maybe still does) automatically start a download to your Home Xbox.
