It makes sense that just discarding a flush 5 doesn't unlock it, because it can cause you to accidentally unlock it in a high card run where you're farming rebate and dilute the planet pool, but if you're using burnt joker you're probably actively trying to play that hand eventually, and it can be annoying to have to give up the extra level just to unlock it by playing it now.
It's definitely a really minor detail but I think it makes sense
