Had a run where I had this joker and ran into that blind. I did not and could not use any discards as it was set to zero prior.
Seems as though the check for the joker is only for currDiscards == maxDiscards rather than if the discard event was fired that round.

I had the same issue, but my discards were set to zero using the Burglar joker

It looks like the game assumes "you have zero discards? You must have used at least one". I had zero discards, but I also didn't use any

Or you could say the card is programmed properly but is worded unclearly
